Excluding someone from benefiting from your estate

Whilst we have testamentary freedom in this country, it is not as simple as you might think to cut some one out of your Will that has been or is a dependant, the law isn’t as comfortable and clear-cut with this as you may be. So we have to be mindful of The Inheritance (Provision for Family & Dependants) Act 1975 which allows those who have either been excluded or left insufficient financial provision to contest your Will through the Courts.

The process brings into the equation additional beneficiaries, not just the person you don’t want to benefit, but more often than not, two legal firms that are fighting it out for each side, and all at your cost.

Despite what we might wish to believe, this is quite a common issue and there is more than one way of dealing with it. It is a job to be done very carefully.
