Theres a new dementia case every 3 minutes in the UK. It is a ticking time bomb that could easily affect you and your family, so plan to get your Power of Attorney’s done sooner rather than later. 

My dad is the Court appointed deputy (via the Court of Protection) for my mum who has advanced dementia. She could stay like this for many years to come. Getting deputyship took us over six months and cost over 2,000. We also have hefty fees to pay every year, we have to record everything we have spent of her money and report this to the Court every year. This could all have been avoided if Lasting Power of Attorney had been set up in time. So my message to everyone out there is get yours done whilst you can

Remember you can only set up a Lasting Power of Attorney if you have mental capacity. Once you have lost capacity, it will be too late.

Don’t forget that you might need to use a Power of Attorney for several years, well before there’s any need for a Will.

This is such an important message to get across, so please dont dismiss it.

So where can you go to get your LPAs set up?

  1. You can do it yourself by downloading the forms and guidance instructions from uk, many try, a lot get into difficulties (its much like trying to write your own Will) and eventually realise they need help.
  2. Which? have their own online tool and legal services company and offer to capture your information and prepare your LPAs for 139 each. Neither this option nor the first one above come with any advice, guidance or recommendations through the process, so buyer beware.
  3. Using a solicitor will mean getting advice and paying for it handsomely too, typically upwards of 500 per LPA. You will have the hassle of attending their offices during 9-5 at least twice, once for instruction and again for the signing process.
  4. You could use a member of the Institute of Professional Willwriters, you will get better advice, a more personal service, pay half the cost of a solicitor, and have the meeting in your home at no extra cost.

It’s just a shame that … 

It is just a shame that Martin Lewis, MoneySavingExpert hasnt appreciated what a good option IPW members are. It is also a shame that Which? see this as a money-spinner and dont realise that advice and recommendations are extremely important factors in the process of setting up Lasting Power of Attorney.
